Expert report: Where liability is clear, an expert report is a necessary cost of repair and is reimbursed (§ 249 Abs. 2 BGB) — you do not pay for it upfront.

Hire car and loss of use: If you cannot use your vehicle during repairs, or until you obtain a replacement, you are entitled to reimbursement of the necessary hire car costs, or — if you don’t take a hire car — to loss-of-use compensation, likewise as part of your claim for restitution (§ 249 BGB).

Total loss and notional settlement: If the repair costs significantly exceed the replacement value, you can claim the amount needed for repair instead of actually carrying it out (§ 249 Abs. 2 BGB) — known as notional (fiktive) settlement. I check which method of settlement is more economically favourable for you.

In a road traffic accident with a clear liability position, the costs of pursuing your legal claim form part of the recoverable loss (§ 249 BGB) and are covered by the other driver's liability insurer — keeper's liability follows from § 7 Abs. 1 Straßenverkehrsgesetz (StVG, the Road Traffic Act). You can also bring your claim directly against the insurer (§ 115 Versicherungsvertragsgesetz). If liability is disputed, or contributory fault is in play, I clarify this with you in advance.
How much pain and suffering compensation can I get after a road accident?
Where your body or health has been injured, you are entitled to reasonable financial compensation for the non-material harm (§ 253 Abs. 2 BGB). There are no fixed amounts — the sum depends on the nature and duration of the injury, the length of treatment, and the impact on your daily life. I quantify your claim based on the medical records and negotiate it with the insurer.
Do I have to pay for an expert report myself after an accident?
Where the liability split is not only marginally in your favour, an expert report is part of the necessary costs of repair and is reimbursed by the other driver's insurer (§ 249 Abs. 2 BGB) — you do not have to pay upfront, provided liability is clear in principle. For minor damage, a repair estimate is often sufficient. I check which approach is right in your case.
What does legal representation after a road traffic accident cost?
Where liability is clear, the other driver's liability insurer regularly bears my fees under the German Lawyers' Fees Act (RVG) as part of your compensation claim. Alternatively, or in addition, your own legal expenses insurance often covers the cost — I submit the coverage request on your behalf. I discuss the specific framework transparently at our first meeting.
