Order for payment procedure, enforcement order, and limitation in detail

Order for payment procedure: For monetary claims, an order for payment can be issued on application (§ 688 ZPO); applications from Bavaria are handled by the Central Order for Payment Court at Coburg Local Court. If the debtor doesn’t lodge an objection, an enforcement order can then be applied for.

Enforcement order: It is equivalent to a provisionally enforceable default judgment (§ 700 ZPO) and is therefore an enforceable title. An objection is possible within two weeks of service — after that, enforcement proceedings begin.

Limitation: The standard limitation period is three years (§ 195 BGB) and generally begins at the end of the year in which the claim arose and the creditor became aware of the circumstances giving rise to it. I check whether your claim is still enforceable.

Damages: Anyone who unlawfully and intentionally or negligently injures another person’s life, body, health, property, or another right is obliged to compensate the resulting loss (§ 823 Abs. 1 BGB). I help you quantify and enforce the loss.

On application, the court issues an order for payment (Mahnbescheid) for a specified sum of money (§ 688 ZPO, the German Code of Civil Procedure); for Bavaria, the Central Order for Payment Court at Coburg Local Court has jurisdiction. If the debtor doesn't object in time, an enforcement order (Vollstreckungsbescheid) can then be applied for, which is equivalent to a provisionally enforceable default judgment (§ 700 ZPO).
