Certificate of inheritance at the Ebersberg Probate Court — how to apply

Without a certificate of inheritance, banks and the land registry often won't act. How to apply for one at the Ebersberg Probate Court, and what to watch out for.

After a death, heirs quickly face a practical hurdle: banks, insurers and the land registry all require proof of the right to inherit. That proof is the certificate of inheritance (Erbschein) — it is issued on application by the probate court and states your right to inherit and, where relevant, your share of the estate (§ 2353 BGB).

Which court is responsible?

As a rule, the competent court is the probate court at the deceased’s last place of residence. For Landkreis Ebersberg, that is the Ebersberg Local Court (Amtsgericht Ebersberg) (Probate Court, Bahnhofstraße 19) — a short journey for anyone living in the area.

What you need for the application

How I can help you

I prepare the application for the certificate of inheritance together with the necessary evidence, clarify your share of the estate, and support you where several co-heirs or a community of heirs are involved. You’ll find an overview of the compulsory portion, disclaiming an inheritance, and statutory succession on the Inheritance Law page.

Not sure whether you need a certificate of inheritance at all? Get in touch — sometimes a notarised will is enough on its own.
